E-Learning Terms of Sale & Use

By purchasing or accessing any online course, you agree to these Terms and to our
Privacy Policy and
Cookie Policy.

1. Introduction & Scope

These Terms govern the purchase and use of online training, digital learning materials, and e-learning content provided by Richardson Rail Services Ltd, including any associated or trading names such as Richardson Training Services (“we”, “us”, “our”).

By purchasing or accessing any course or digital content from our website, you agree to be bound by these Terms and our Privacy and Cookie Policies. If you do not agree, do not complete your purchase or access our materials.

These Terms apply to individuals purchasing courses and to employers or clients purchasing on behalf of candidates via our website or learning management system (LMS).

3. Purchase Process & Pricing

  • Prices are in GBP and exclusive of VAT unless stated otherwise.
  • Payment is due in full at checkout or by approved invoice.
  • You must ensure checkout details (name, email, candidate information) are correct. Errors causing delays or certificate issues are not refundable.
  • Digital access is granted automatically or within two (2) Business Days after cleared payment.

4. Digital Access & Licence

Upon purchase, you are granted a non-exclusive, non-transferable, limited licence to access and use the course content solely for your personal training and assessment purposes.

You must not:

  • Share, copy, distribute, record, or reproduce any course content, videos, documents, or assessments.
  • Allow others to use your account or login credentials.
  • Download or reproduce content beyond what is clearly permitted for personal learning.

All intellectual property remains the property of Richardson Rail Services Ltd or its licensors. Breaches may result in immediate termination and legal action.

5. Course Access Period

  • Unless stated otherwise, access lasts 90 days from enrolment.
  • Extensions may be granted at our discretion and may incur an additional fee.
  • After expiry, access to the course, quizzes, resources, and certificates will be withdrawn.

6. Certificates & Completion

  • Certificates are issued only when all mandatory requirements are completed successfully.
  • We may withhold certificates if required uploads or evidence are incomplete, inaccurate, or unverifiable.
  • Certificates may show “Richardson Training Services” or “Richardson Rail Services Ltd” (same legal entity).

7. Refunds, Cancellations & Consumer Rights

7.1 Digital Content and Cooling-Off Period

Under the Consumer Contracts Regulations 2013, you usually have 14 days to cancel a digital purchase. By starting or accessing the course, you expressly request immediate digital delivery and agree to lose your right to cancel.

  • If you access any part of the course, no refund is due.
  • If you have not accessed the course, you may cancel within 14 days by emailing training@richardsonrail.co.uk.

7.2 Refunds for Online Purchases

  • Refunds may be granted only if access has not been used, the request is within 14 days, and the course has not been completed, downloaded, or accessed.
  • Approved refunds are processed to the original payment method within 14 Business Days.

7.3 Course Errors or Platform Issues

  • We will restore access promptly or offer a course transfer or replacement for faults caused by our system.
  • No refunds for temporary outages or user-side device or network issues.

7.4 Chargebacks and Unauthorised Payments

Unauthorised chargebacks will be contested with evidence of access and digital delivery. Repeated or bad-faith refund claims may result in account suspension and recovery of costs.

8. Substitutions & Transfers

  • Before access begins, a learner substitution (name or email) may be requested with an administration fee of £25.
  • Once a course is accessed or started, substitutions or transfers are not permitted.

9. Technical Requirements

You are responsible for ensuring your device, browser, and internet connection are suitable for accessing the LMS. We are not liable for incompatibility due to outdated systems, firewalls, or local IT restrictions.

10. Account Conduct

  • Keep login credentials confidential and accurate.
  • Do not impersonate or misrepresent your identity.
  • Do not upload or share inappropriate or offensive content.

Breaches may result in immediate suspension or termination without refund.

11. Limitation of Liability

  • Content is provided for educational purposes only. Confirm suitability for any required certification before purchase.
  • Our total liability shall not exceed the course price paid.
  • We are not liable for indirect or consequential losses such as loss of income, opportunity, or data.
  • Nothing limits liability for death, personal injury, or fraud.

12. Data Protection & Privacy

Personal information is processed in line with our Privacy Policy and Cookie Policy. We may process course progress, results, and certificates for training delivery, records, and compliance.

13. Termination & Suspension

We may suspend or terminate access without refund if you breach these Terms, misuse or share materials, provide false information, or act in a way that damages our intellectual property or reputation. Termination does not affect our right to recover unpaid fees or losses caused by breach.

14. Changes to Terms

We may amend these Terms periodically. Updates will be posted on this page with the revision date. Material changes affecting your purchase may also be notified by email.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
